This is a book in which Imam Al-Nawawi collected the contents of the three books that discuss the subject of the etiquette of fatwa, mufti, and questioner, and included to them precious things from the miscellaneous words of his companions. By summarizing these three books, Al-Nawawi has preserved for us the content of two books, one of which does not have a copy known in our time, which is the book of Al-Saymari, although the predecessors knew it. As for the other, which is the book of Al-Khatib Al-Baghdadi, a few of the ancients knew it, including Imam Al-Nawawi. So the probability of its existence in our time was less than precedent.
The author introduced his book with a speech about the importance of issuing fatwas and the great danger and virtue of it, then he followed that with three chapters on knowing who is fit to give a fatwa, about the necessity of the mufti’s piety and religion, and the conditions of the mufti. Then he held a chapter on the categories and conditions of muftis: independent and non-independent. Then he spoke in a chapter about some issues of the mufti’s eligibility.
Then he collected various issues under three headings: Rulings of muftis. Fatwa literature, fatwa literature, its description and rulings.
According to this arrangement, Al-Nawawi created his summary: He thus violated the order of his originals. This becomes clear by reviewing Ibn Al-Salah’s book and comparing it with Al-Nawawi’s summary, where you will find that Al-Nawawi absorbed all the contents of Ibn Al-Salah’s book, each with a new template and arrangement, which gave the structure of his book strength and durability.
The subject of the book does not matter to the mufti or questioner in the rulings of religion, but rather to everyone who needs to ask or be questioned. For example, in our time, every employee whose work needs to answer a question needs it, as he learns from this book how to control his answer and be careful in his writing, thus preserving His writings are about additions, manipulations, and additions. Indeed, everyone who works in the field of documents needs it, as he benefits from this summary of the basic rules of his work.

Abu Zakaria Yahya bin Sharaf Al-Hazami Al-Nawawi Al-Shafi’i (631 AH - 1233 AD / 676 AH - 1277 AD), known as “Al-Nawawi,” is a Muslim hadith scholar, jurist, and linguist, and one of the most prominent Shafi’i jurists. He is famous for his many books and classifications in jurisprudence, hadith, language, and biographies, such as Riyadh Al-Salehin, Al-Arba’in Al-Nawawi, Minhaj Al-Talibeen, and Al-Rawdah. He is described as the editor of the Shafi’i school of thought, its refiner, its reviewer and its arranger, as the work among Shafi’i jurists has settled on what Al-Nawawi suggests is most likely. Al-Nawawi is called the Sheikh of the Shafi’is. If the word “two sheikhs” is used according to the Shafi’is, they mean Al-Nawawi and Abu Al-Qasim Al-Rafi’i Al-Qazwini.

At the beginning of his treatise, Imam al-Nawawi, may God have mercy on him, issued a quote from the predecessors about the fatwa and its seriousness, including:
(I realized that one hundred and twenty of the Ansar were among the Companions of the Messenger of God, may God bless him and grant him peace. One of them was asked about the matter, and this one returned it to this and this to this until it returned to the first) Abd al-Rahman Ibn Abi Laila.. and On the authority of Ibn Masoud and Ibn Abbas, may God be pleased with them: Whoever issues a fatwa on every Whatever he asks, he is crazy.. (If one of you gives a fatwa on the issue, even if it had come to Omar ibn al-Khattab, may God be pleased with him, the people of Badr would have gathered for it.) Al-Sha’abi, Al-Hasan, and Abu Husayn.. (I have encountered people asking one of them about the question. And he speaks while he is thundering.” (Ata’ bin Al-Sa’ib Al-Taba’i..) If the scholar is negligent, I do not know, his fighter will be injured.) Ibn Abbas... On the authority of Al-Shafi’i, he was asked about a matter and did not answer, so he was told and he said, “Until I know that the merit is in silence or in the answer.”
